Use of data, information and web applications available to users at the AJPES web portal (hereinafter referred to as: web portal) is subject to the conditions defined below.
Liability
Users of the web portal use the data from the registries and other records in accordance with the applicable regulations and conditions which are published for the use of individual AJPES services.
Users use the web portal at their own risk. AJPES shall not be responsible for any damages incurred by the user due to incorrect access, misuse or inability to use the data, information and web applications available on the web portal. Users must independently arrange for protection of his information equipment, which is required for unhindered and secure access to the data (anti-intrusion protection, virus protection and protection from malicious software...).
AJPES accepts no responsibility for the accuracy of the data it obtains from the business entities or through the European Business Register (EBR) information network provided by foreign providers, pursuant to these conditions and Terms of Use and Sales of data from the European Business Register in respect of End Users.
Personal data protection
AJPES shall use the personal data kept in the Slovenian Business Register which business entities report to AJPES in the course of the registration procedures for registration purposes only, and shall not make this data available to third parties, except in the case of entering contact information (telephone number, e-mail address, website of the business entity) into the Slovenian Business Register. AJPES may erase contact data from the Slovenian Business Register at any time at the request of the business entity.
To use web services, users must log into the AJPES web portal with a username and password. During the registration procedure users must provide certain data to AJPES (e.g. their e-mail address). AJPES uses this data for this purpose alone and shall not disclose them to third parties.
Users of the web portal
The users of the web portal can be anonymous or registered. Anonymous users may use the free-of-charge services (e.g. review the data contained in the Slovenian Business Register) and that portion of the payable services which they can pay without identification on the part of AJPES (e.g. information on the credit rating of individual companies - eS.BON, payable through the Moneta payment service or credit/debit cards). In addition to the above services, registered users may also use the services which require identification (e.g. entering statistical data) and the payable services which they can subscribe to. The username and password of registered users applies to the person who registered for access to the individual service. Registered users accept responsibility for all activities performed using their username and password.
AJPES shall charge for the use of payable services of the web portal according to applicable pricelists and tariffs.
Terms of Use of data and information acquired through the web portal
Data available through the AJPES web services are part of the databases in the AJPES information system, which are – as a whole and as individual parts of the system – protected under the Slovenian Copyright and Related Rights Act. It is prohibited to remove or replace the registered trademarks used by AJPES.
The same protection also applies to the manner and scope of use of the databases of EBR members accessible via the EBR application, which are protected under local national legislation or EU conventions.
Users of data and information available through the web portal must respect the provisions of the Copyright and Related Rights Act which govern the rights of the database creators, and the provisions of the Act on the Access to Information of Public Character which govern the reuse of public information. The user may, at any time, only use insignificant portions of the databases (with regard to quality and/or quantity), up to the extent envisaged in the context of available web applications. All other forms of further intermediation, or provision of use to third parties (e.g. publication on a third-party server, reproduction in other documents etc.) are expressly prohibited. This prohibition refers to all forms of usage which extend beyond the limits of personal use. The following courses of action are especially prohibited:
- use of significant portions (in the sense of quality and/or quantity) of databases (e.g. reproduction of the database structure, parts of database structure, creating private and public databases etc.),
- database use contrary to their regular use, or in a manner which could be harmful to the interests of AJPES (e.g. systematic and repeated use of insignificant parts of databases, etc.),
- capturing significant parts (in the sense of quality and/or quantity) of databases through use of specialized program solutions,
- removal of quoted sources.
The user shall be held accountable for any misappropriation of data and damages which AJPES may incur as a result of breach of the above terms and limitations.
Links to websites
Links to the web portal or the homepage and/or individual subpages are allowed, provided that no markings, symbols or notices which are governed under the regulations governing copyrights and related rights and other notices on the relevant website are removed or obscured. AJPES shall demand the link to be removed in the event of detected abuse.
Web portal accessibility
Under normal circumstances AJPES shall ensure the users' non-stop access to the web portal, 24 hours a day. For technical reasons (i.e. maintenance purposes and/or equipment replacement), brief interruptions to the web portal's operation, or interrupted access, may occur, normally after 17:00.
AJPES shall provide data and documents from business registers participating in the EBR Network subject to the conditions and availability ensured by the EBR or individual EBR members, i.e. at minimum Monday to Friday between 8.00 and 18.00. AJPES shall not be responsible for any technical difficulties suffered by other members of the EBR (delays or connection issues on the EBR Network, failure of the EBR Network or issues caused by external factors).
Dispute resolution
AJPES shall endeavor to amicably resolve any disputes arising from failure to use the web portal in accordance with the provisions contained in the General Terms and Conditions of Use. In the event that the dispute cannot be resolved amicably, the matter shall be resolved by the relevant court in Ljubljana.
