Usage of data, information and applications available to users at the AJPES web portal (hereinafter referred to as: web portal) is subject to the conditions and limitations defined below.
Liability
The content available from the web portal does not represent official information unless expressly marked as such. The data, information and web applications available through the web portal www.ajpes.si may be subject to change without prior notice.
Users use the web portal at their own risk. Neither AJPES nor any other legal entities involved in the creation or maintenance of the web portal are not directly or indirectly liable for any damages arising from accessing, use, or inability to use of the information and applications available through the web portal.
AJPES does not extend any guarantee that the information which AJPES obtains from business entities is accurate. Any liability on the part of AJPES for damages which the users may incur as a result is therefore wholly excluded.
Privacy
In certain places on the web portal, AJPES collects certain identification data about the users (name, surname, address, telephone number, e-mail address). Users submit this information to AJPES on a voluntary basis. AJPES guarantees that it shall only use such information for its own purposes and that it shall not disclose such information to third parties.
Users of the web portal
The users of the web portal can be anonymous or registered. Anonymous users may use the free-of-charge services (e.g. review the data contained in the Slovenian Business Register) and that portion of the payable services which they can pay without identification on the part of AJPES (e.g. review the data contained in the Register of Non-Possessory Liens and Seized Movable Property – RZPP, payable through the Moneta payment service). In addition to the above services, registered users may also use the services which require identification (e.g. entering statistical data) and the payable services which they can subscribe to. Registered users have a username and password associated with the person who subscribed for the individual service. The username and password must be protected as a business secret and must not be disclosed to a third party. Registered users accept responsibility for all activities performed using their username and password.
AJPES shall charge the use of the payable services of the web portal according to the current pricelist of AJPES services available on the web portal.
Extent of use of the databases and intellectual property rights
The users of the web portal must act in accordance with the following:
- the databases in the AJPES information system – as a whole and as individual parts of the system – are protected pursuant to the Slovenian Copyright and Related Rights Act,
- the data used by AJPES in its provision of web services are a part of the databases in the sense defined by the provisions of the Slovenian Copyright and Related Rights Act,
- the mark "FI-PO Ajpes '04" is protected as service mark or trademark, pursuant to the Slovenian Industrial Property Act.
Among other things, the Slovenian Copyright and Related Rights Act asserts that, at any time, the user may only use insignificant portions of the databases (with regard to quality and/or quantity), up to the intended extent in the context of the web applications available for anonymous or registered users. All other forms of further intermediation, or provision of use to third parties (e.g. publication on a third-party server, reproduction in other documents etc.) are expressly prohibited.
- This prohibition refers to all forms of usage which extend beyond the limits of personal use. The following courses of action are especially prohibited:
- use of significant portions (with regard to quality and/or quantity) of databases (e.g. reproduction of the database structure, parts of the database structure, groups of records etc.),
- database use contrary to their regular use, or in a manner which could be harmful to the interests of AJPES (e.g. systematic and repeated use of insignificant parts of databases, etc.),
- capturing significant parts (in the sense of quality and/or quantity) of databases through use of specialized program solutions,
- removal of quoted sources.
Removal or replacement of the marks "AJPES" and/or "FI-PO Ajpes '04" is also prohibited when they appear on individual data and information sheets.
The user is liable for all damages which AJPES may incur as a result of breach of the above terms and limitations.
Use of data and information acquired from the web portal
No data or information acquired through the web portal may be used for commercial purposes without prior consent from AJPES. It is prohibited to collect the data or information from the web portal in any form of a public or private compilation of data. Publication of data elsewhere in any shape or form is prohibited unless this is expressly allowed in individual pieces of data or information.
The user may download data and information acquired from the web portal to their own system for private use, where he or she may not change the statements regarding copyright and related rights. With the intent of use for private or non-commercial purposes, printing data and information is allowed. Photocopying, forwarding, republication, alteration of data and information, sending via post, or any other form of dissemination is expressly prohibited without prior consent from AJPES.
Links to websites
Linking to the web portal, i.e. the main page and/or individual subpages, is allowed under the following conditions:
- that there is no removal or concealment of signs, marks or statements regarding the protection of the copyright and related rights, or other notices on the individual page,
- that the web link is removed at the request of AJPES.
The web portal may also contain links to other websites not under the administration of AJPES. Consequently, AJPES cannot be held responsible for the contents of these websites.
Accessibility to the web portal
AJPES endeavors to ensure the users' unhindered access to the web portal – 24 hours a day under normal circumstances. For technical reasons (i.e. maintenance purposes and/or equipment replacement), AJPES reserves the right to brief interruptions to the web portal's operation, or interrupted access, normally after 17:00 (5pm) CET.
Dispute resolution
The users and AJPES shall endeavor to resolve any disputes arising from failure to use the web portal in accordance with the provisions contained in the General Terms and Conditions for Use of the AJPES Web Portal. In the event that the dispute cannot be resolved in such a way, the matter will be resolved by the court of jurisdiction in Ljubljana.
